1.2 Information Collected Automatically

As a provider of VoIP telephone services, we collect certain information related to your use of the Services:
- Call Detail Records (CDRs): Originating phone number, destination phone number, date, time, and duration of calls, call type (inbound/outbound/forwarded)
- Voicemail Recordings: Voicemail messages left for you or by you through the Services
- Call Recordings: If you enable the call recording feature, recordings of telephone calls
- SMS/MMS Records: Phone numbers involved in messaging, date and time of messages, message delivery status
- Fax Records: Fax transmissions sent or received through the Services
- Service Performance Data: Call quality metrics, network performance data, error logs
1.4 Information from Third Parties
We may receive information about you from:
- Telecommunications Carriers: Information related to number porting and call routing
- Payment Processors: Transaction confirmation and fraud prevention data
- Analytics Providers: Aggregated website usage data
- Public Databases: Business information for verification purposes (e.g., Secretary of State filings, CNAM databases)
- Referral Partners: If you were referred to us, basic contact information shared by the referring party with your knowledge

- Send transactional and informational SMS/MMS messages related to your account and services

3.3 Marketing and Promotional Communications
- With your express consent, send promotional emails, newsletters, and marketing SMS/MMS messages about our products, services, and special offers
- Personalize marketing content based on your interests and service usage

4. SMS AND TEXT MESSAGING DISCLOSURES
This section specifically addresses the collection, use, and protection of information related to SMS and MMS text messaging. This section supplements — and does not replace — the other provisions of this Privacy Policy.
4.1 SMS Opt-In and Consent
We send text messages only to individuals who have provided their express prior consent. You may provide consent by:
- Checking the SMS consent checkbox on a form on our Site
- Texting a keyword (e.g., “START” or “YES”) to a VoIPSimplicity phone number
- Verbally consenting during a telephone call with a VoIPSimplicity representative
- Otherwise expressly requesting to receive text messages from us
Consent to receive SMS/MMS messages is not required as a condition of purchasing any product or service from VoIPSimplicity.
4.2 Types of Text Messages
Depending on your selections and account activity, you may receive the following types of text messages from VoIPSimplicity:
- Transactional / Service Messages: Account activation confirmations, service status updates, billing reminders, payment confirmations, appointment reminders, support case updates, emergency or outage notifications
- Promotional / Marketing Messages: Special offers, discounts, new feature announcements, company news (sent only if you have opted in to marketing messages)
4.3 Message Frequency
Message frequency varies based on your account activity, service selections, and communication preferences. Transactional messages are sent as needed based on account events. Marketing messages, if you opt in, will not exceed [3] messages per month unless otherwise disclosed at the time of opt-in.
4.4 Message and Data Rates
Message and data rates may apply. Text messaging charges from your wireless carrier are your responsibility. VoIPSimplicity is not responsible for any fees charged by your carrier for sending or receiving text messages.
4.5 Opt-Out of Text Messages
You may opt out of receiving text messages from VoIPSimplicity at any time by:
- Replying STOP (or QUIT, CANCEL, UNSUBSCRIBE, or END) to any text message you receive from us
- Emailing us at [email protected] with the subject line “SMS Opt-Out” and including the phone number you wish to remove
- Calling us at (844) 769-8647 and requesting removal
After you opt out, you will receive one final confirmation message stating that you have been unsubscribed. You will not receive any further text messages from us unless you re-subscribe. Please allow up to 48 hours for opt-out requests to be fully processed.
Note: Opting out of marketing text messages does not opt you out of service-critical transactional messages related to your active VoIP service account (e.g., emergency service notices, fraud alerts). If you wish to stop all messages, please contact us directly.

4.7 SMS Data Sharing Restrictions
We do not sell, rent, lease, or share your mobile phone number, SMS opt-in data, or SMS consent information with third parties or affiliates for their marketing or promotional purposes.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
The only circumstances in which SMS-related data may be disclosed to third parties are:
- Service Providers: We may share data with telecommunications carriers and messaging platform providers strictly as necessary to deliver text messages on our behalf. These providers are contractually prohibited from using your information for any other purpose.
- Legal Compliance: We may disclose information when required by law, regulation, legal process, or governmental request.
- Protection of Rights: We may disclose information when necessary to protect the rights, property, or safety of VoIPSimplicity, our customers, or the public.
4.8 SMS Records Retention
We retain SMS opt-in consent records, opt-out records, and message logs for a minimum of five (5) years or as required by applicable law and regulations, including TCPA and FCC requirements. This data is stored securely and accessed only for compliance, auditing, and dispute resolution purposes.
4.9 Supported Carriers
SMS messaging services from VoIPSimplicity are supported on all major U.S. wireless carriers, including but not limited to AT&T, Verizon Wireless, T-Mobile, U.S. Cellular, and their respective MVNOs. Carrier support is subject to change without notice. Carriers are not responsible for delayed or undelivered messages.
5. HOW WE SHARE YOUR INFORMATION
We do not sell your personal information. We may share your information in the following limited circumstances:
5.1 Service Providers and Vendors
We share information with trusted third-party companies that perform services on our behalf, including:
- Telecommunications carriers and interconnect providers (for call routing, number porting, SMS delivery, and CNAM services)
- Cloud hosting and infrastructure providers (for data storage and computing)
- Payment processors (for billing and payment processing)
- Customer relationship management (CRM) platforms
- Email and messaging delivery services
- Analytics and website optimization providers
- Customer support tools (helpdesk, live chat, ticketing systems)
These service providers are contractually obligated to use your information only for the purposes of providing services to VoIPSimplicity and are required to maintain the confidentiality and security of your data.
5.2 Legal Obligations and Law Enforcement
We may disclose your information when we believe in good faith that disclosure is necessary to:
- Comply with a legal obligation, regulation, or valid legal process (e.g., subpoena, court order, government request)
- Comply with FCC regulations, CPNI rules, and other telecommunications law requirements
- Respond to requests from law enforcement or other government agencies
- Provide E911 emergency service information to public safety answering points (PSAPs) and emergency responders
- Protect and defend the rights, property, or safety of VoIPSimplicity, our customers, our employees, or the public
- Detect, prevent, or investigate fraud, security issues, or technical problems
5.3 Business Transfers
If VoIPSimplicity is involved in a merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on our Site of any change in ownership or use of your personal information, as well as any choices you may have regarding your information.
5.4 With Your Consent
We may share your information for purposes not described in this Privacy Policy if we have obtained your express consent to do so.
5.5 Aggregated or De-Identified Data
We may share aggregated, anonymized, or de-identified information that cannot reasonably be used to identify you with third parties for analytics, research, industry benchmarking, and other lawful purposes.

7. THIRD-PARTY LINKS AND SERVICES
Our Site may contain links to third-party websites, services, or applications that are not owned or controlled by VoIPSimplicity. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services before providing your information to them.

8. DATA RETENTION

- Physical Security: Data hosted in SOC 2 compliant data centers with physical access controls, surveillance, and environmental protections
- Employee Training: Regular privacy and security awareness training for all staff
- Vendor Management: Due diligence and contractual data protection requirements for third-party service providers
- Monitoring and Auditing: Regular security assessments, vulnerability scanning, and access log reviews
No method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. We will respond to your request within 30 days (or sooner if required by applicable law). We may need to verify your identity before processing your request by asking you to confirm information associated with your account.
If you are an authorized agent making a request on behalf of a consumer, we may require proof of authorization (such as a signed power of attorney or written consent from the consumer).
11. CALIFORNIA PRIVACY RIGHTS (CCPA/CPRA)
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA).

Residents of states with comprehensive consumer privacy laws may have rights similar to those described in Section 10, including the right to access, correct, delete, and opt out of certain processing activities. 12.2 Customer Proprietary Network Information (CPNI)
As a telecommunications service provider, VoIP Simplicity is subject to FCC regulations regarding Customer Proprietary Network Information (CPNI) under 47 U.S.C. § 222 and 47 C.F.R. Part 64. CPNI includes information about the quantity, technical configuration, type, destination, location, and amount of use of your telecommunications service, as well as billing information related to your telephone service.
We will:
- Protect CPNI in accordance with FCC regulations
- Not use, disclose, or share your CPNI without your approval, except as permitted by law
- Use CPNI only for the purpose of providing you with the telecommunications services you have requested, or as required by law
- Provide you with notice and opportunity to restrict use of your CPNI for marketing additional services

13. CHILDREN’S PRIVACY
Our Site and Services are not directed to children under the age of thirteen (13), and we do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without verified parental consent, we will take prompt steps to delete that information.
14. INTERNATIONAL USERS
