SMS TERMS & CONDITIONS
These SMS Terms & Conditions (“SMS Terms“) govern your receipt of and interaction with Short Message Service (SMS) and Multimedia Messaging Service (MMS) text messages from VoIPSimplicity (“VoIPSimplicity LLC,” “Company,” “we,” “us,” or “our“), a Georgia limited liability company with its principal place of business at 5710 Ogeechee Road, Suite 200-267, Savannah, GA 31405.
These SMS Terms supplement our Terms of Service, Privacy Policy, and Acceptable Use Policy. By opting in to receive text messages from VoIPSimplicity, you agree to these SMS Terms. If you do not agree, do not opt in to receive text messages and contact us to withdraw any previously given consent.

1. OVERVIEW OF OUR MESSAGING PROGRAMS
VoIPSimplicity provides voice over internet protocol (VoIP) telephone services, business communication tools, and related products to residential and small business customers. As part of our Services, we offer SMS and MMS messaging capabilities for the following purposes:
- Account and Service Communications: Notifications related to your VoIPSimplicity account, including account activation, service status updates, billing reminders, payment confirmations, and maintenance or outage alerts
- Customer Support: Responses to support inquiries, troubleshooting assistance, and service case updates
- Appointment and Service Reminders: Reminders related to scheduled installations, consultations, or service appointments
- Security and Fraud Alerts: Notifications related to account security, suspicious activity, or fraud prevention
- Promotional and Marketing Messages: Special offers, discounts, new feature announcements, product updates, and company news (sent only with your express written consent to receive marketing messages)
2. CONSENT AND OPT-IN
2.1 How You Provide Consent
You may opt in to receive text messages from VoIPSimplicity through any of the following methods:
- Website Forms: By entering your mobile phone number and checking the SMS consent checkbox on any form on our website at www.voipsimplicity.com including but not limited to: quote request forms, contact forms, sign-up/registration forms, and support request forms
- Keyword Opt-In: By texting a designated keyword (e.g., “START,” “YES,” or “JOIN“) to a VoIPSimplicity phone number or short code
- Verbal Consent: By verbally consenting to receive text messages during a telephone call with a VoIPSimplicity representative (verbal consent is documented in our records)
- Written/Electronic Consent: By providing written or electronic consent through a service agreement, order form, or other document
2.2 Consent Is Voluntary
Your consent to receive SMS/MMS messages from VoIPSimplicity is completely voluntary and is not a condition of purchasing any product or service from us. You may purchase and use VoIPSimplicity services without opting in to text messaging.
2.3 Consent Confirmation
After you opt in, you will receive a confirmation text message that includes:
- Identification of VoIPSimplicity as the sender
- A description of the type of messages you will receive
- Message frequency disclosure
- “Message and data rates may apply” notice
- Instructions for opting out (reply STOP)
- Instructions for getting help (reply HELP)
- A link to these SMS Terms and our Privacy Policy
Example confirmation message:
“VoIPSimplicity: You’re subscribed to [account alerts / promotional messages]. Msg frequency varies. Msg & data rates may apply. Reply STOP to opt out, HELP for help. Terms: voipsimplicity.com/sms-terms”
2.4 Age Requirement
You must be 18 years of age or older (or the age of majority in your jurisdiction) to opt in to VoIPSimplicity’s messaging programs. By opting in, you represent and warrant that you meet this age requirement.
2.5 Authorization for the Number Provided
By providing a mobile phone number and opting in to receive messages, you represent and warrant that:
- You are the account holder for the mobile phone number provided, or you have the account holder’s express authorization to opt in to messaging on that number
- The phone number you provided is accurate and belongs to you
- You will promptly notify VoIPSimplicity if you change your mobile phone number
3. TYPES OF MESSAGES
Depending on your selections and account activity, you may receive the following categories of text messages from VoIPSimplicity:
3.1 Transactional and Informational Messages
These messages relate directly to your account and use of VoIPSimplicity services:
- Account activation and setup confirmations
- Service provisioning and number porting status updates
- Billing and payment reminders
- Payment confirmation receipts
- Service maintenance and outage notifications
- Security alerts and fraud notifications
- Support ticket updates and case resolution notices
- E911 address update reminders
- Two-factor authentication (2FA) codes (if applicable)
3.2 Promotional and Marketing Messages
These messages are sent only if you have provided separate, express written consent to receive marketing communications:
- Special offers and promotional discounts
- New service and feature announcements
- Plan upgrade opportunities
- Referral program information
- Company news and updates
- Event invitations
- Customer satisfaction surveys
You may opt in to or out of promotional messages independently from transactional messages. Opting out of promotional messages will not affect service-critical transactional messages related to your active account.
4. MESSAGE FREQUENCY
4.1 Transactional Messages
Message frequency varies based on your account activity and service events. Transactional messages are sent on an as-needed basis and may include:
- Account-triggered alerts (e.g., payment processed, service activated)
- Support-initiated messages (e.g., case updates in response to your inquiry)
- Security notifications (e.g., login alerts, fraud warnings)
There is no fixed cap on transactional messages, as they are driven by account activity. However, we make reasonable efforts to limit messages to those that are necessary and relevant.
4.2 Promotional Messages
If you opt in to receive promotional messages, you can expect to receive no more than [3] marketing messages per month unless otherwise disclosed at the time of a specific promotional campaign opt-in.
4.3 Overall Frequency
Message frequency varies. The total number of messages you receive will depend on your account activity, service selections, support interactions, and whether you have opted in to promotional messaging.
5. MESSAGE AND DATA RATES
Standard message and data rates may apply. Text messaging charges from your wireless carrier are your sole responsibility. VoIPSimplicity does not charge a separate fee for sending or receiving SMS/MMS messages as part of account communications, but your wireless carrier may charge you per-message fees or deduct messages from your wireless plan allotment.
If you have questions about your wireless plan and messaging charges, please contact your wireless carrier directly.
6. HOW TO OPT OUT
You may opt out of receiving text messages from VoIPSimplicity at any time using any of the following methods:
6.1 Reply STOP
Reply STOP (or any of the following keywords: QUIT, CANCEL, UNSUBSCRIBE, END) to any text message you receive from VoIPSimplicity.
You will receive one final confirmation message confirming that you have been unsubscribed. For example:
“VoIPSimplicity: You have been unsubscribed and will no longer receive text messages from us. Reply START to re-subscribe. Need help? Call (844) 769-8647.”
After this confirmation, no further messages will be sent unless you re-subscribe.
6.2 Email Request
Send an email to [email protected] with:
- Subject line: “SMS Opt-Out”
- Body: Include the mobile phone number you wish to unsubscribe and your name
6.3 Phone Request
Call us at (844) 769-8647 during business hours and request to be removed from our messaging list.
6.4 Written Request
Send a written opt-out request to:

6.5 Opt-Out Processing Time
- Reply STOP: Processed immediately (within minutes). You may receive one final confirmation message.
- Email, phone, or mail requests: Processed within 48 hours of receipt.
6.6 Partial Opt-Out
- If you wish to stop promotional/marketing messages only but continue receiving transactional account messages, please contact us at (844) 769-8647 or support [email protected] to adjust your preferences.
- If you reply STOP, it will opt you out of all messaging programs. If you wish to re-subscribe to transactional messages only, reply START or contact us.
6.7 Re-Subscribing
If you previously opted out and wish to re-subscribe, you may:
- Reply START or YES to a VoIPSimplicity number
- Re-submit a form on our website with the SMS consent checkbox selected
- Call us at (844) 769-8647 to verbally re-subscribe
7. HOW TO GET HELP
If you need assistance with our text messaging services or have questions about these SMS Terms:
7.1 Reply HELP
Reply HELP to any text message from VoIPSimplicity. You will receive a response message with contact information and basic instructions. For example:
“VoIPSimplicity SMS Help: For assistance, call (844) 769-8647 or email [email protected]. To opt out, reply STOP. Msg & data rates may apply.”

8. PRIVACY AND DATA PROTECTION

In connection with our SMS messaging programs, we collect and retain:
- Your mobile phone number
- Your opt-in consent records (including the method, date, time, and content of opt-in)
- Your opt-out records (including the method, date, and time of opt-out)
- Message delivery and receipt logs (including date, time, and delivery status)
- The content of messages you send to us (e.g., STOP, HELP, or support-related replies)
8.2 How We Use SMS Data
We use SMS-related data to:
- Deliver text messages you have consented to receive
- Process opt-in and opt-out requests
- Maintain compliance records as required by the TCPA, FCC, CTIA, and carrier regulations
- Respond to your inquiries and support requests
- Improve our messaging services
8.3 Data Retention
We retain SMS consent records (opt-in and opt-out) and message logs for a minimum of five (5) years or as required by applicable law, including TCPA and FCC requirements. This data is stored securely and accessed only for compliance, auditing, dispute resolution, and legal purposes.
8.4 Security

9. NO MOBILE INFORMATION SHARING
VoIPSimplicity does not sell, rent, lease, or share your mobile phone number, SMS/MMS opt-in data, or SMS/MMS consent information with third parties or affiliates for their marketing or promotional purposes.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
The only circumstances in which SMS-related data may be disclosed to a third party are:
- Service Delivery: We may share your phone number and message data with telecommunications carriers and messaging platform providers strictly as necessary to transmit and deliver text messages on our behalf. These providers are contractually prohibited from using your information for any other purpose.
- Legal Compliance: We may disclose information when required by law, regulation, subpoena, court order, or other valid legal process.
- Protection of Rights: We may disclose information when necessary to protect the rights, property, or safety of VoIPSimplicity, our customers, or the public.
10. SUPPORTED CARRIERS
VoIPSimplicity’s SMS messaging services are supported on all major U.S. wireless carriers, including but not limited to:
- AT&T
- Verizon Wireless
- T-Mobile (including Sprint)
- U.S. Cellular
- And most MVNOs (Mobile Virtual Network Operators) operating on these networks
Carrier participation and support is subject to change without notice. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to the terms and policies of your wireless carrier.
VoIPSimplicity is not responsible for messages that are not delivered due to:
- Carrier network issues or outages
- Device incompatibility
- Changes in your wireless carrier’s policies
- Your device being powered off, out of range, or unable to receive messages
- Full message inbox or storage limitations on your device
11. DISCLAIMER OF WARRANTY AND LIABILITY
11.1 No Warranty
SMS AND MMS MESSAGING SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. VOIPSIMPLICITY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- Messages will be delivered without delay or error
- Messages will be delivered to all carriers or all devices
- The messaging service will be uninterrupted, secure, or error-free
- Message content will be accurate or complete in transmission
11.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VOIPSIMPLICITY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:
- YOUR USE OF OR INABILITY TO USE OUR SMS/MMS MESSAGING SERVICES
- DELAYED, UNDELIVERED, OR MISDIRECTED MESSAGES
- ANY UNAUTHORIZED ACCESS TO OR INTERCEPTION OF YOUR MESSAGES
- ANY CHARGES IMPOSED BY YOUR WIRELESS CARRIER FOR SENDING OR RECEIVING TEXT MESSAGES
- ANY ERRORS, OMISSIONS, OR INACCURACIES IN MESSAGE CONTENT
11.3 Carrier Liability
Wireless carriers are not responsible for delayed or undelivered messages. VoIPSimplicity is not the agent of any wireless carrier and makes no representations on behalf of any carrier.
12. DISPUTE RESOLUTION
Any disputes arising out of or relating to these SMS Terms shall be resolved in accordance with the dispute resolution provisions set forth in our Terms of Service, which are incorporated herein by reference.
13. CHANGES TO THESE SMS TERMS
VoIPSimplicity reserves the right to modify these SMS Terms & Conditions at any time. When we make changes:
- We will update the “Last Updated” date at the top of this page
- We will post the revised SMS Terms at www.voipsimplicity.com/sms-terms
- For material changes, we may notify you via text message, email, or a prominent notice on our website
Your continued participation in our messaging programs after the posting of updated SMS Terms constitutes your acceptance of the changes. If you do not agree with the revised terms, you may opt out at any time by replying STOP to any message or contacting us using the methods described in Section 6.
